5% SHOOT-READY REBATE
The photoshoot is the first and most important showing of your listing. When a home is fully shoot-ready upon arrival, we are able to move efficiently through the property, and we recognize that with a 5% rebate toward a future shoot. To qualify, the home must be ready when we arrive, with no occupants, pets, or vehicles on site, and no changes needed during the appointment. This rebate does not apply to land/lot or short-term rental shoots.

I agree to carefully review the confirmation email and ensure that my client is prepared to accommodate the appointment duration specified in that email. The total appointment time specified is based on the assumption that the property is 'show-ready' upon photographer's arrival. If the property is not 'show-ready', additional time may be required. If you or your client cannot accommodate the required time needed for the media ordered, please contact SPMG. Once on-site, the photographer reserves the right to reschedule if the duration of time specified in the appointment confirmation email is not accommodated.
License Agreement Scope: The Southeast Property Media Group License Agreement covers any video, photograph, graphics, digital assets, or images created or captured by Southeast Property Media Group or its contractors for a specific property and delivered to the Client. This Agreement defines the relationship between the parties, and any modifications must be in writing.
Rights and License: All rights, including copyrights and ownership of the photos and videos, remain with Southeast Property Media Group. The Client is granted a limited license to reproduce, publicly display, and distribute the images solely for promotional purposes related to the property's sale. Any other use requires permission from Southeast Property Media Group, which may involve additional fees.
The Client may upload images to MLS listing services for property promotion. The Client does not have the right to transfer any copyrights or exclusive rights. Unless otherwise agreed in writing, the license lasts for one year from the Agreement date or until the property representation ends, whichever comes first. Further use beyond this period requires permission from Southeast Property Media Group and may incur additional fees. Rights are granted to the Client upon delivery of the images.
An exclusive license may be requested by the commissioning party. Images of multi-family properties, neighborhood amenities, and general neighborhood overviews remain the property of Southeast Property Media Group without an exclusive license. Southeast Property Media Group retains the right to use these images for its own marketing.
Both parties agree that the Photographer and/or Videographer is an independent contractor, and neither Southeast Property Media Group nor its personnel are employees of the Client. Neither party can act as an agent for the other except as stated in this Agreement. Deliverables from Southeast Property Media Group are not considered "works for hire" under copyright law, and all rights granted to the Client are defined by this Agreement.
Creation: The Photographer has sole discretion over the methods and manner of creating the images, and the Client cannot control this process. The Photographer will strive to meet the Client's specifications and deliver publishable-quality images by the deadlines.
Transfer and Assignment: The Client may not assign or transfer this Agreement or its rights. Any amendments or waivers must be in writing and signed by both parties. The invoice may include authorizations made without written confirmation due to time constraints.
Indemnification: The Client agrees to indemnify and defend Southeast Property Media Group and its contractors against any claims, liabilities, or expenses arising from the creation or use of photos or materials provided by the Client. The Client is responsible for obtaining necessary releases.
General Law/Arbitration: This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements. It is governed by South Carolina law, and any disputes must be resolved in Charleston, South Carolina. The prevailing party in any litigation is entitled to recover attorney fees. If negotiations fail, either party may initiate mediation or binding arbitration in a mutually agreed forum.
Waiver: No action, other than a written waiver, will be interpreted as a waiver of any provision of this Agreement. A single or partial exercise of rights does not preclude further exercise of other rights or remedies.
